The U.S. Equal Employment Opportunity Commission said a jury returned a verdict of $36.1 million in favor of the agency on disability discrimination claims against Drivers Management and Werner Enterprises.
The agency said Victor Robinson was awarded $75,000 in compensatory damages and $36 million in punitive damages after a jury found that both companies’ conduct violated the Americans with Disabilities Act.
Werner said it is disappointed with the jury’s decision, adding that earlier in the year a jury in the same court found in the company’s favor on nearly identical facts. The logistics-services provider said it is evaluating its options relative to an appeal of the decision.
Drivers Management didn’t immediately respond to a request for comment.
The EEOC filed its lawsuit in the U.S. District Court for the District of Nebraska.
